These Terms of Service ("Terms") are an agreement between you and NovaBrief ("NovaBrief", "we", "us") and govern your use of the NovaBrief mobile application, website, shared pages and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read Section 15 carefully. It requires most disputes to be resolved by individual binding arbitration rather than in court, and waives class actions and jury trials, unless you opt out as described there.
You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service. By using it, you confirm that you meet this requirement and can form a binding contract. The Service is not intended for anyone under 18.
NovaBrief is a personalized news application. It shows short summaries of stories reported by third-party publishers, written automatically with artificial intelligence, with the publisher's name and a link to the original article; sends briefings and notifications; and lets you ask follow-up questions about stories ("Ask Nova"). We may add, change, suspend or remove features at any time, and we do not guarantee that the Service or any content will always be available.
You need an account (Sign in with Apple, Google, or email) to use the Service. Provide accurate information, keep your credentials confidential, and tell us promptly at support@novabrief.ai if you think your account has been used without permission. You are responsible for all activity under your account. Accounts are personal and may not be shared, sold or transferred.
Stories in the Service are based on articles published by third parties. Where available, an article's image is displayed as provided by the publisher's website. Articles, images, names and trademarks belong to their respective owners; NovaBrief does not claim ownership of them and their appearance does not imply endorsement. Links take you to third-party websites that we do not control; we are not responsible for their content, accuracy, availability or practices, and your use of them is governed by their terms.
When you share a story or an Ask Nova conversation, we create a public web page that anyone with the link can view. You are responsible for what you choose to share and for complying with the law when you share it. Do not share anything private, confidential, unlawful or that infringes someone else's rights. We may remove any shared page at any time, and shared pages are deleted when you delete your account.
You can report a story or an Ask Nova answer from within the app. We review reports and may, at our discretion, correct, label, hide or remove any content, including withdrawing a story from the Service everywhere. We are not obligated to monitor content and are not liable for acting or not acting on any report.

If you believe content in the Service infringes your copyright, email support@novabrief.ai with: (1) your contact information; (2) a description of the copyrighted work; (3) where the material appears in the Service (for example, a link or the story's headline and date); (4) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and (6) your physical or electronic signature. We will review and, where appropriate, promptly remove or disable access to the material, and may terminate the accounts of repeat infringers.
The Service, including its software, design, branding and the text we generate, is owned by NovaBrief or its licensors and protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes. All rights not expressly granted are reserved. If you send us feedback or suggestions, you allow us to use them without restriction or compensation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NOVABRIEF AND ITS OWNER, OPERATORS, SUPPLIERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR INVESTMENT, ARISING OUT OF OR RELATING TO THE SERVICE, ANY CONTENT (INCLUDING AI-GENERATED CONTENT AND THIRD-PARTY CONTENT), OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US $50. THESE LIMITS APPLY TO ALL THEORIES OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
To the extent permitted by law, you agree to defend, indemnify and hold harmless NovaBrief and its owner and operators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your use or misuse of the Service, content you share, or your violation of these Terms, the law, or anyone's rights.
You may stop using the Service and delete your account at any time from Settings → Account → Delete Account, which permanently removes your account and associated data. We may suspend or terminate your access at any time if you violate these Terms or to protect the Service, other users, or us. Sections that by their nature should survive termination (including 5, 6 and 10 through 19) will survive.
If you downloaded the app from Apple's App Store: these Terms are between you and NovaBrief, not Apple, and NovaBrief (not Apple) is solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims, nor for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's Standard Licensed Application End User License Agreement also applies, to the extent it does not conflict with these Terms.
We may update these Terms from time to time. We will post the updated Terms here and change the effective date, and for material changes we will give notice in the app or by email. Changes take effect when posted (or on the date stated), and continuing to use the Service afterwards means you accept them. If you do not agree, stop using the Service and cancel your subscription.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs Section 15. These Terms (with the Privacy Policy) are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
